We are not liable for delays caused by circumstances beyond our reasonable control.

7. Cancellation and Refunds

Either party may terminate a project by providing written notice. In the event of cancellation:

• You will be billed for all work completed up to the cancellation date
• Deposits are generally non-refundable
• You may receive work-in-progress files at our discretion
• We retain the right to use any concepts or work developed as part of the project

We respect the confidential nature of information shared during our projects. We will not disclose confidential client information to third parties without permission, except as required by law or as necessary to complete the agreed services.

If your project requires a formal non-disclosure agreement (NDA), please request one before sharing sensitive information.

We warrant that our services will be performed in a professional and workmanlike manner. However:

• We do not guarantee specific results or outcomes from our services
• This website and services are provided "as is" without warranties of any kind
• We are not responsible for third-party services, platforms, or tools used in projects
• We do not warrant that our website will be uninterrupted or error-free

To the maximum extent permitted by law, Theta State Studios shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly.

Our total liability for any claims arising from our services shall not exceed the amount paid by you for the specific services giving rise to the claim.

These Terms shall be governed by and construed in accordance with the laws of the State of Washington, United States, without regard to its conflict of law provisions.

Any disputes arising from these Terms or our services shall be resolved in the courts located in Spokane County, Washington.

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to this website. Your continued use of our services after changes are posted constitutes acceptance of the modified Terms.
